I do not see his punishment as an example of "home cooking" if he only pleaded guilty to a DUI as a first offense. It is my understanding that the maximum first time DUI penalty is one year in Colorado. Work release is not an uncommon outcome for persons that do not otherwise pose a threat to society.

In this case, Russell had to complete counseling. He will get to spend 7 months in jail (less time off for good behavior). He will have to pay restitution. He may get sued by the officer for his personal injuries.

His sentence appears not to be a slap on the wrist or entry level first time DUI sentence such as 10-30 days. It appears as if his extremely high BAC (.246), plus open container, plus the collision/injury with/to the officer has resulted in the sentence being increased.
