In California, per Welfare and Institutions Code Sections 5150 et seq., a 72 hour hold may take place if there exists probable cause that an individual is a danger to himself/herself, a danger to other others, or is gravely disabled (incapable of providing for one's basic needs for food, clothing and shelter). [Sorry, in my former existence I was a probable cause hearing officer for mental health hearings for about 10 years and heard hundreds, if not thousands of hearings in which those very issues were contested in proceedings that take place after the 72 hours expires and the mental health facility still wants to detain the held person. I had to decide whether or not the alleged mentally ill person would be released or could still be involuntarily detained.]
