Not only the civil suits, but the criminal penalties for hit and run in Texas can amount to prison time of up to 20 years, if there is serious bodily injury, which appears to be the case:

Have said many a time since that day that if Cam Cameron had just kept handing off to LT and turner, the Chargers would still have the ball to this day, running all over the Patriots

The only thing that stopped the Chargers offense that day was passing the ball.
